Terms of Service

Welcome to FLOWCO, an AI-powered audio transcription and summarization service operated by CyberIntel Limited ("we", "our", or "us"). By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service. These Terms constitute a legally binding agreement between you and CyberIntel Limited. Please read them carefully.

FLOWCO provides AI-powered audio and video transcription and summarization services, including but not limited to: • Audio and video file transcription using advanced AI models • Intelligent content summarization and key point extraction • Support for streaming platform content (YouTube, podcasts, etc.) • RSS feed audio blog subscription and summarization • PDF report generation with transcripts and summaries • Multi-language transcription support (50+ languages) We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with or without notice.

3.1 Account Creation To access certain features, you must create an account by providing accurate and complete information, including a valid email address. 3.2 Account Security You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorized use 3.3 Account Eligibility You must be at least 13 years old to use our service. Users under 18 must have parental consent. 3.4 Account Termination We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4.1 Pricing Plans FLOWCO offers multiple subscription tiers: • Free Plan: 2 hours/week with basic features • Monthly Plan: $9.99/month with 60 hours/month and premium features • Yearly Plan: $99.9/year with 60 hours/month and premium features 4.2 Billing • Subscriptions are billed in advance on a recurring basis • Payment is processed through Stripe, our secure payment provider • All prices are in US Dollars (USD) • Prices are subject to change with 30 days notice 4.3 Auto-Renewal Subscriptions automatically renew unless cancelled before the renewal date. 4.4 Taxes Prices do not include applicable taxes. You are responsible for all taxes associated with your purchase.

5.1 Cancellation You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. 5.2 Refund Policy Please refer to our separate Refund Policy for detailed information about refunds and refund eligibility. 5.3 No Refunds for Partial Periods We do not provide prorated refunds for partial subscription periods unless required by law.

6.1 Plan Limitations Each subscription plan has specific usage limits as described in the pricing section. Exceeding these limits may result in: • Temporary service suspension until the next billing cycle • Requirement to upgrade to a higher tier plan • Additional usage fees 6.2 Fair Use Policy You agree not to: • Use the service for illegal purposes or to process illegal content • Attempt to circumvent usage limits or access controls • Share your account credentials with others • Use automated systems to abuse or overload the service • Resell or redistribute our service without authorization • Upload content containing malware or malicious code 6.3 File Size and Length Limits • Free Plan: Max 1 hour audio, 2GB file size • Paid Plans: Max 10-20 hours audio, up to 10GB file size (depending on plan)

7.1 Your Content You retain all rights to the audio files and content you upload. By using our service, you grant us a limited license to: • Process your audio files for transcription and summarization • Store your content temporarily to provide the service • Use anonymous, aggregated data to improve our AI models 7.2 Our Intellectual Property All service features, AI models, software, designs, and trademarks are owned by CyberIntel Limited and protected by intellectual property laws. You may not: • Copy, modify, or reverse engineer our service • Use our trademarks without written permission • Extract or reuse any portion of our service code or AI models 7.3 Generated Content Transcriptions and summaries generated by our AI are provided for your use. However, you acknowledge that AI-generated content may contain errors and should be reviewed for accuracy.

8.1 Privacy Policy Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. 8.2 Data Security We implement industry-standard security measures including: • HTTPS/TLS encryption for all data transmission • AES-256 encryption for server storage • Automatic deletion of audio files within 24 hours after processing 8.3 Data Processing Your audio content is processed using AI models. We do not listen to your audio manually unless required for customer support or legal compliance. 8.4 Your Responsibilities You are responsible for: • Ensuring you have rights to upload and process your content • Not uploading confidential information without proper authorization • Complying with applicable data protection laws

You agree not to upload, process, or share content that: • Violates any laws or regulations • Infringes on intellectual property rights • Contains hate speech, harassment, or discrimination • Depicts or promotes violence, illegal activities, or terrorism • Contains child sexual abuse material (CSAM) • Violates privacy rights of others without consent • Contains malware, viruses, or malicious code • Is spam, fraudulent, or deceptive Violation of these terms may result in immediate account termination and legal action.

10.1 Service Availability While we strive for high availability, we do not guarantee uninterrupted or error-free service. We may experience: • Scheduled maintenance periods • Unexpected technical issues • Service degradation during high demand 10.2 Transcription Accuracy AI transcription accuracy depends on: • Audio quality and clarity • Speaker accents and speaking speed • Background noise and audio conditions We aim for industry-leading accuracy but cannot guarantee 100% accuracy. You should review all transcriptions for critical use cases. 10.3 Processing Time Typical processing time is 2-5 minutes per hour of audio. Processing times may vary based on: • System load and demand • File size and complexity • Your subscription tier (paid users have priority processing)

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 11.1 No Warranty The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. 11.2 Limitation of Damages CyberIntel Limited shall not be liable for: • Indirect, incidental, special, or consequential damages • Loss of profits, data, or business opportunities • Damages arising from service interruptions or errors • Damages exceeding the amount you paid in the past 12 months 11.3 Indemnification You agree to indemnify and hold harmless CyberIntel Limited from any claims, losses, or damages arising from: • Your violation of these Terms • Your content or use of the service • Your violation of any third-party rights

Our service integrates with third-party platforms and services including: • Payment processing (Stripe) • Cloud infrastructure (AWS, GCP) • Streaming platforms (YouTube, podcast providers) We are not responsible for the availability, content, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

We reserve the right to modify these Terms at any time. When we make material changes, we will: • Post the updated Terms on this page • Update the "Last Updated" date • Notify you via email or service notification (for material changes) Your continued use of the service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service and cancel your account.

14.1 Governing Law These Terms are governed by the laws of the jurisdiction where CyberIntel Limited operates, without regard to conflict of law principles. 14.2 Dispute Resolution Before filing any legal claim, you agree to first contact us at support@flowco.tech to attempt to resolve the dispute informally. 14.3 Arbitration If informal resolution fails, disputes shall be resolved through binding arbitration rather than court proceedings, except where prohibited by law. 14.4 Class Action Waiver You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

15.1 Entire Agreement These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CyberIntel Limited. 15.2 Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. 15.3 No Waiver Our failure to enforce any provision does not constitute a waiver of that provision. 15.4 Assignment You may not assign or transfer these Terms. We may assign our rights and obligations without restriction. 15.5 Force Majeure We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.
